Acceptance of Terms

By accessing and using the services provided by commonoybi B.V. ("we", "our", or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. These terms apply to all visitors, users, and customers of commonoybi automotive repair services.

Services Description

commonoybi provides professional automotive repair and maintenance services including but not limited to engine repair, brake service, vehicle diagnostics, regular maintenance, electrical system repairs, and related automotive services. All services are performed by qualified technicians using appropriate tools and equipment.

Customer Obligations

As a customer of commonoybi, you agree to:

• Provide accurate and complete information about your vehicle and any issues
• Authorise repairs and services before work begins
• Pay for services in accordance with our payment terms
• Retrieve your vehicle within a reasonable time after completion of services
• Comply with all applicable laws and regulations
• Treat our staff and facilities with respect

Pricing and Payment

All prices are quoted in Euros (EUR) and include applicable VAT where required. Payment is due upon completion of services unless alternative arrangements have been made in advance. We accept cash, bank transfers, and major payment cards. Late payment may result in storage charges and legal action for debt recovery.

Warranties and Guarantees

We provide warranties on our workmanship and parts as follows:

• Labour warranty: 12 months from completion of work
• Parts warranty: As per manufacturer specifications or 12 months, whichever is longer
• Warranties are void if the vehicle is modified or repaired by others
• Warranties cover defects in workmanship but not normal wear and tear

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of commonoybi or its content suppliers and is protected by Dutch and international copyright laws. The commonoybi name and logo are trademarks of commonoybi B.V. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Limitation of Liability

To the maximum extent permitted by law, commonoybi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the theory of liability, whether based on warranty, contract, statute, tort, or otherwise.

Vehicle Storage and Abandonment

Vehicles left on our premises for more than 30 days after completion of work or notification of completion may be considered abandoned. We reserve the right to charge reasonable storage fees and, after providing proper notice, to dispose of abandoned vehicles in accordance with Dutch law.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Cancellation and Rescheduling

Appointments may be cancelled or rescheduled with at least 24 hours' notice. Cancellations with less notice may be subject to a cancellation fee. We reserve the right to reschedule appointments due to unforeseen circumstances, emergencies, or equipment failures.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. Upon termination, your right to use our services will cease immediately, though any outstanding obligations for payment will remain in effect.

Force Majeure

commonoybi shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Dutch courts. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Severability

If any provision of these Terms of Service is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms of Service. We recommend reviewing these terms periodically.
